The Statute
Louisiana paraphernalia is governed by LRS §40:1023. Possession or delivery of paraphernalia is a separate misdemeanor from possession of cannabis itself, with a separate penalty schedule:
- Possession of paraphernalia (1st offense) — up to 6 months in parish jail and a fine of up to $1,000.
- Subsequent offenses — escalating penalties, potentially felony exposure with PWID-style enhancements.
- Delivery of paraphernalia — separate offense; commercial sale of paraphernalia to minors is felony-level.
What Counts as Paraphernalia
Idaho courts have treated as paraphernalia, when accompanied by residue or context:
- Pipes (glass, metal, ceramic).
- Bongs and water pipes.
- Dab rigs.
- Vape cartridges and vape pens.
- Grinders.
- Rolling papers (when accompanied by residue).
- Roach clips.
- Scales (especially with residue).
- Storage containers with cannabis residue.
- "Hidden compartment" or smell-proof bags marketed for cannabis.
Note: this is the Louisiana statutory framework — though many of these treatments are common across U.S. paraphernalia jurisprudence.
The Probable-Cause Multiplier
The presence of paraphernalia plus odor is routinely cited by Louisiana State Police and parish sheriffs as probable cause to search a vehicle. A pipe in a center console plus an officer's claim of "smelling marijuana" is, in most Louisiana parishes, sufficient legal basis for a full vehicle search.
Parish-by-Parish Enforcement
- Orleans Parish (New Orleans) — DA Williams's office has effectively de-prioritized paraphernalia prosecution. Most paraphernalia citations are dismissed or diverted.
- East Baton Rouge — Paraphernalia citations proceed to municipal court; conviction rates are higher than Orleans.
- St. Tammany Parish — Aggressive paraphernalia prosecution paired with possession.
- Rural sheriffs (I-10, I-49 corridors) — Routine traffic-stop paraphernalia charges, often with civil-forfeiture exposure for cash and vehicles.
- LSU and college campuses — Paraphernalia in dorms triggers university conduct-board action plus criminal referral.
Decriminalization Doesn't Cover Paraphernalia
HB 652 (2021) decriminalized possession of 14 g or less of cannabis itself. It did not decriminalize paraphernalia. A defendant cited under HB 652 for ≤14 g may still face a separate paraphernalia charge with the full §40:1023 penalty schedule. In Orleans Parish this rarely produces meaningful prosecution; in St. Tammany or rural parishes it can produce conviction.
Vape Cartridges in Louisiana
Vape cartridges occupy a particularly gray space. Cartridges sold by the ten Louisiana Marijuana Pharmacies are part of authorized medical product. Cartridges sold at smoke shops or gas stations — typically Delta-8 THC, Delta-10, or HHC products — exist in a legal gray zone:
- Federal hemp law (2018 Farm Bill, 0.3% THC threshold) covers some products.
- Mexican-formulated or unregistered Delta-8/HHC products may exceed thresholds.
- Louisiana enforcement varies; some parishes treat all THC vapes as cannabis paraphernalia.
For Visitors
- Don't leave paraphernalia in plain view in your vehicle. A pipe in a rental-car cupholder is routine probable cause.
- Don't bring paraphernalia from a legal state. A vape pen lawfully purchased in California is paraphernalia under LRS §40:1023.
- Don't pack paraphernalia in checked luggage. TSA finds get referred to local law enforcement at your destination airport.
- Smoke shops are not safe haven. Buying in Louisiana doesn't make use lawful in Louisiana.
